By placing an order on derrickfilmsit.com, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this site or place an order.

Every image on this site is original fine-art photography created and edited by Derrick Johnston. We do our best to represent each piece faithfully, but please keep the following in mind:

• Colors, contrast, black levels, and tonal range may look different on your screen than on the finished print. Monitors and phones vary widely in calibration, brightness, and color gamut, and we cannot match every device.
• Prints are produced on fine-art papers — Glossy (coated) or Matte (uncoated) — and may exhibit the subtle texture, grain, or tonal variation inherent to those materials.
• Every print is made to order, and minor variations between individual copies of the same image are normal and are not defects.

We do not warrant that your print will be an exact color or tonal match to any particular screen or prior purchase.

All prints are provided “as is” without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. Color, tone, and finish may vary from on-screen previews due to monitor calibration, screen settings, and the nature of fine art printing materials. These variations are inherent to the medium and do not constitute a defect.

All physical orders are produced, optionally framed, packaged, and shipped by Gelato, an independent third-party print-on-demand partner. We do not print, frame, package, or ship any items ourselves.

In the event of a production or fulfillment issue, your remedies are limited to replacement of the affected print or a refund of the purchase price, at our discretion. We are not responsible for indirect, incidental, or consequential damages.

If something goes wrong with your order, please contact us first and we will work in good faith with Gelato to pursue a reprint, replacement, or other resolution where available.

Your purchase of a physical print grants you ownership of that physical object only. It does not transfer any copyright, license, or reproduction right. You may not reproduce, scan, photograph, or digitize the print for redistribution; resell the print commercially without our prior written permission; or use any image — digital or physical — for commercial purposes, merchandise, NFTs, AI training data, editorial licensing, or advertising.

Unauthorized use of our images may be pursued under the U.S. Copyright Act (17 U.S.C. § 101 et seq.) and other applicable law.

To the fullest extent permitted by law, our total liability to you for any claim arising from or related to your purchase, the website, or any product is limited to the amount you paid for the specific item at issue.

We are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, loss of goodwill, or emotional distress, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the maximum extent permitted.

Estimated production and delivery windows shown at checkout are provided by Gelato for informational purposes only. We do not guarantee any specific delivery date.

Neither Derrickfilmsit nor Gelato is liable for delays or failures caused by events outside our reasonable control, including natural disasters, severe weather, fires, power or internet outages, strikes, labor shortages, carrier disruptions, customs holds, pandemics, governmental actions, or acts of war or terrorism (“force majeure”).

Because every print is custom-produced to order, we do not accept returns or exchanges. No returns are accepted for change of mind, color preference, or buyer’s remorse.

Remedies for defective, damaged-in-transit, or misprinted items are limited to replacement or refund at our sole discretion. To request a remedy, email us at info@derrickfilmsit.com within 14 days of delivery with your order number and clear photos showing the issue. We will review the claim with Gelato and respond with the available resolution.

Orders generally cannot be cancelled once they have been transmitted to Gelato for production, which typically happens shortly after payment.

These terms and any dispute arising out of or related to them are governed by the laws of the State of Texas and the applicable federal laws of the United States, without regard to conflict-of-law principles. Exclusive venue for any dispute lies in the state or federal courts located in Williamson County, Texas, and you consent to personal jurisdiction there.

Submitting a booking inquiry through our contact form does not constitute a confirmed booking or enforceable contract. A session is only confirmed once Derrick Johnston has expressly agreed in writing (including by email or text message) and both parties have agreed on a date, location, and session fee.

Session types. We offer family portrait, social media portrait, automotive, and business photography sessions. We do not photograph weddings, elopements, or engagement sessions.

Payment. Session fees are due on the day of the shoot unless otherwise agreed in writing in advance. Accepted payment methods are cash, Apple Pay, or Tap to Pay. We do not process booking payments through this website.

Cancellations.Please provide at least 48 hours’ notice if you need to cancel or reschedule. No-shows or late cancellations may result in a cancellation fee, which will be communicated at the time of booking confirmation.
